GENERAL TERMS AND CONDITIONS OF CONTRACT AND USE

1. Object

These General Terms and Conditions of Contract and Use (hereinafter, the “Terms”) govern:

  1. Access to and use of the NomadIA.Digital platform (the “Platform”).
  2. The conditions under which users can book services, activities or products offered by third-party providers through the Platform.
  3. The rights and obligations arising from the contractual relationship between the user and NomadIA.Digital when it acts as an intermediary in said reservations.

These Terms and Conditions must be accepted by the user at the time of registration or contracting.

2. Identity of the holder

This site is owned by NOMADIA ONE, SL with CIF B22967509, which has its registered office at Paseo Campos de Castilla, 1, 40195-Segovia (not open to the public).

3. Nature of the NomadIA.Digital service

NomadIA.Digital acts as:

  • Information platform about destinations for digital nomads.
  • Intermediary in the booking of certain services provided by third-party providers (coworking spaces, tourist, cultural, and sporting activities, events, professional services, etc.).

Unless expressly stated otherwise, NomadIA.Digital:

  • It is not the final provider of the reserved services.
  • It does not guarantee the availability, quality or correct execution of services provided by third parties.
  • It is not part of the direct contractual relationship between user and provider.

NomadIA.Digital simply provides a technological platform that facilitates the booking and exchange of information.

4. Registration and account creation

To access certain services, the user must register by creating an account, providing truthful and up-to-date information.

The user agrees to:

  • Maintain the confidentiality of your credentials.
  • Report any unauthorized access.
  • Update your information when necessary.

NomadIA.Digital may suspend or cancel accounts in case of fraudulent, illegal, or contrary use of these Terms.

5. Contracting and booking process

The user will be able to book services offered by third-party providers by following the process indicated on the Platform.

Before confirming a reservation, the following will be displayed:

  • Detailed description of the service
  • Supplier identity
  • Total price
  • Supplier-specific conditions
  • Cancellation or modification policy
  • Service requirements, if any

The booking will be effective when the user receives an email confirmation.

6. Price, payments and invoicing

Prices will be shown in the indicated currency and will include applicable taxes, unless otherwise stated.

NomadIA.Digital will be able to:

  • Manage collections on behalf of the end supplier
  • Redirect the user to the provider's gateway.
  • Issue your own invoices or delegate invoicing to the supplier

The user declares to be the owner of the payment method used.

NomadIA.Digital does not store card data, thus complying with GDPR and PCI-DSS standards, unless tokenization systems provided by the payment provider are used.

7. Cancellations, modifications and refunds

Cancellation policies depend on the final provider and will be displayed before booking.

NomadIA.Digital will not be responsible for:

  • Cancellations or modifications made by the supplier
  • Refunds handled by third parties
  • Changes to service schedules, availability, or content

NomadIA.Digital may act as an intermediary to facilitate communication between user and provider.

8. Responsibility of NomadIA.Digital

NomadIA.Digital will not be responsible for:

  • The execution, quality or safety of services provided by third parties
  • Damages or losses arising from the activity of the suppliers
  • Outdated information provided by third parties
  • Interruptions or technical failures not attributable to NomadIA.Digital

NomadIA.Digital will only be liable for direct damages resulting from its own failures attributable to its technological activity.

9. User obligations

The user agrees to:

  • Make proper and lawful use of the Platform
  • Do not use the Platform for fraudulent or illegal purposes
  • Respect the supplier's specific conditions
  • Provide truthful information and do not impersonate others.

Failure to comply may result in the cancellation of the account without entitlement to compensation.

10. Information and content about destinations

The information published on destinations, prices, coworking spaces, visas, activities or recommendations is for guidance only and may change over time.

NomadIA.Digital does not guarantee its absolute accuracy.
The user must verify critical information such as:

  • Entry requirements and visas
  • Tax regulations
  • Health or safety conditions

11. Data Protection (GDPR)

The processing of personal data will be governed by the Privacy Policy, prepared in accordance with the GDPR.

NomadIA.Digital complies with:

  • Principle of legality, fairness and transparency
  • Data minimization
  • Temporary limitation of conservation
  • Integrity and confidentiality
  • Record of treatment activities
  • Contracts with data processors
  • International transfers in accordance with GDPR (SCC, adequacy decisions, etc.)

Purposes of the processing related to these Conditions:

  • Account Management
  • Reservation processing
  • User communication
  • Fraud prevention
  • Compliance with legal obligations
  • Service improvement and analytics (with consent)

12. Security

NomadIA.Digital implements appropriate technical and organizational measures:

  • TLS/SSL encryption
  • Access control
  • Incident monitoring
  • Backups
  • Cloud providers with GDPR compliance

In the event of a security incident affecting personal data, notification will be made as required by the GDPR (arts. 33 and 34).

13. Intellectual Property

All content on the Platform (texts, images, logos, design, software) belongs to NomadIA.Digital or is used under license, and is protected by intellectual property regulations.

Reproduction or exploitation without authorization is prohibited.

14. External links

The Platform may include links to third-party websites. NomadIA.Digital is not responsible for their content or operation.

15. Modifications to the Conditions

NomadIA.Digital may modify these Terms at any time.
New versions will be published on the web and users will be notified when the changes are substantial.
Continued use of the Platform implies acceptance of the new conditions.

16. Applicable law and jurisdiction

These Terms are governed by the laws of Spain.

In case of conflict:

  • If the user is a consumer, the courts of their domicile will apply.
  • In other cases, the competent courts will be those of the domicile of NomadIA.Digital.
